These Terms of Service (“Terms”) are a legal agreement between you and Sage Labs SA (“Sage Labs”, “we”, “us”, or “our”) and govern your use of the ExamPilot website and application (the “Service”). Please read them carefully. By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
Who we are
The Service is operated by Sage Labs SA, registered at [REGISTERED OFFICE ADDRESS].
Eligibility and your account
You must be at least [MINIMUM AGE — e.g. 13] to use the Service. If you are under 18, you may use the Service only with the permission of a parent or guardian who agrees to these Terms on your behalf and takes responsibility for your use. You agree to provide accurate information, keep it up to date, and keep your password secure. You are responsible for activity that happens under your account. Accounts are for a single individual and may not be shared.
The Service
ExamPilot is a learning and exam-readiness platform for international school mathematics, such as Cambridge and Edexcel International qualifications. We are continually developing the Service and may add, change, suspend, or remove features at any time. The Service is offered on an evolving, pre-launch basis and may contain errors or be unavailable from time to time.
Educational use only; no guarantees
ExamPilot is a study aid intended to support your own learning and revision. Explanations, practice questions, feedback, and other content — including content generated by AI — may be incomplete, inaccurate, or out of date, and should not be relied on as authoritative. The Service does not provide professional, academic, or examination advice, and we do not guarantee any particular grade, score, or outcome. You are responsible for how you use the Service and its content.
Not affiliated with exam boards
ExamPilot is an independent service. We are not affiliated with, endorsed by, or sponsored by any examination board, awarding body, or school, including (without limitation) Cambridge Assessment International Education and Pearson Edexcel. Names such as “Cambridge”, “Edexcel”, “A-Level”, and “GCSE”, and any related qualification codes, are the trademarks or identifiers of their respective owners and are used only to describe the qualifications the Service helps you prepare for.
Trials, credits, and payments
Access to the Service is currently offered on a trial basis. Certain AI-powered features are metered using in-service credits (“Sparx”); once your allowance is used, those features may be limited until it renews or you obtain more. If and when we offer paid plans or purchases:
- prices will be shown at the point of purchase (currently in euros) and may change over time;
- payments are handled by a third-party payment provider, and by paying you also agree to that provider’s terms;
- unless we state otherwise or the law requires, payments are non-refundable; and
- you are responsible for any applicable taxes.
We will make the specific terms of any paid plan available to you before you purchase.
Acceptable use
You agree to use the Service only for lawful, personal, educational purposes, and not to:
- break the law or infringe the rights of others;
- upload or share content that is unlawful, harmful, deceptive, or infringing;
- access or attempt to access other users’ accounts or data;
- interfere with, disrupt, overload, or probe the Service or its security;
- scrape, copy, or harvest content or data except as we expressly allow;
- reverse engineer, decompile, or attempt to extract source code or underlying models;
- resell, sublicense, or commercially exploit the Service without our permission;
- misuse AI features, including attempting to bypass safety measures or generate prohibited content; or
- use the Service in any way that breaches the rules of an examination board or your school, including any form of academic dishonesty.
Your content
You keep ownership of the content you submit, such as your questions, answers, and uploads (“User Content”). You grant Sage Labs a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, and adapt your User Content as needed to operate, provide, secure, and improve the Service, including by processing it through third-party providers such as AI services. You are responsible for your User Content and confirm that you have the rights to submit it. We may remove content that breaches these Terms.
Our intellectual property
The Service — including its software, design, text, graphics, and the content we provide (but not your User Content) — together with the ExamPilot name and logo, is owned by Sage Labs or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, and revocable licence to use the Service for its intended purpose. No other rights are granted.
Third-party services
The Service may rely on or link to third-party services, such as Google sign-in and our payment provider. We are not responsible for those services, and your use of them is subject to their own terms and policies.
Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any content will be accurate or reliable.
Limitation of liability
To the fullest extent permitted by law, Sage Labs and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of data, results, opportunities, or profits, arising out of or relating to your use of, or inability to use, the Service. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the [12] months before the claim and [EUR 100]. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
Indemnification
To the extent permitted by law, you agree to indemnify and hold Sage Labs harmless from claims, losses, and reasonable expenses (including reasonable legal fees) arising from your misuse of the Service, your User Content, or your breach of these Terms.
Suspension and termination
We may suspend or terminate your access if you breach these Terms, if we are required to by law, or if we need to protect the Service or other users. You may stop using the Service and close your account at any time by contacting us. When your access ends, your right to use the Service ends; sections that by their nature should survive — such as intellectual property, disclaimers, limitation of liability, and governing law — will continue to apply.
Changes to these Terms
We may update these Terms from time to time. We will post the updated version with a new “last updated” date, and where the changes are significant we will take reasonable steps to let you know. If you continue using the Service after the changes take effect, you accept the updated Terms.
Governing law and disputes
These Terms are governed by the laws of [GOVERNING LAW / JURISDICTION], without regard to conflict-of-laws rules. If a dispute arises, we encourage you to contact us first so we can try to resolve it. Any dispute that cannot be resolved informally will be subject to the courts of [VENUE], except where mandatory law where you live gives you the right to bring proceedings elsewhere.
General
These Terms, together with our Privacy Policy, are the entire agreement between you and Sage Labs about the Service. If any part is found to be unenforceable, the rest will remain in effect. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these Terms without our consent; we may transfer ours in connection with a merger, acquisition, or sale of assets. We are not responsible for delays or failures caused by events beyond our reasonable control.
